Terms of Service
Effective September 4, 2026
These Terms of Service ("Terms") are a legal agreement between you and Totalscapes Qld Pty Ltd (ABN 20 696 605 580) ("CRM-007", "we", "us", "our"), trading as CRM-007, an Australian company registered in Queensland, Australia, governing your access to and use of the CRM-007 platform, including our website, dashboard, tracking snippet, and related services (collectively, the "Service").
By creating an account, signing up for a trial, or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of a business or other organization, you're agreeing on that organization's behalf, and "you" refers to both you and that organization.
1. What CRM-007 is
CRM-007 is a multi-tenant customer relationship management platform. Once you install our tracking snippet on your website, the Service attempts to identify the companies behind anonymous website visitors, scores and manages leads and deals through a pipeline, generates shareable client portal pages, and runs a set of autonomous background agents — which you individually enable — that can draft (and, only if you explicitly turn on auto-send, deliver) emails and text messages on your behalf.
Each customer's data is stored in its own isolated database. We do not pool or share your CRM data — contacts, companies, deals, or messages — with other customers.
2. Accounts and eligibility
You must provide accurate information when creating an account and keep your login credentials confidential. You're responsible for all activity that happens under your account, including actions taken by team members you invite. You must be at least 18 years old and able to form a binding contract to use the Service.
3. Plans, billing, and cancellation
CRM-007 offers a Free plan and paid plans (currently Business and Enterprise). Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe — we never see or store your full card details. Paid plans are charged immediately at checkout; we do not currently offer a trial period on paid plans, and any discount or promotional pricing shown at checkout applies only for the period stated there.
You can change or cancel your plan at any time from your billing settings, which opens Stripe's secure billing portal. Cancelling stops future billing but does not automatically entitle you to a refund of amounts already charged, except where required by law. If a payment fails, we'll email you and may suspend access to paid features until it's resolved.
We may change plan pricing or features going forward. If a change materially affects your current plan, we'll give you reasonable notice before it takes effect.
4. Bring-your-own AI and messaging keys
AI-drafted content, the autonomous agents, and outbound SMS are powered by API keys you provide yourself (Anthropic, xAI, OpenAI, and/or Twilio, depending on the feature). We never mark up or bill you for usage on those keys — you're billed directly by the provider you chose, under that provider's own terms. You're responsible for keeping those keys valid, funded, and used in accordance with the issuing provider's terms and any laws that apply to your use of AI-generated or automated communications, including anti-spam and telemarketing laws in your jurisdiction.
5. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk email or text messages, or otherwise violate anti-spam or telemarketing laws applicable to you or your recipients;
- Upload, process, or attempt to identify data you don't have a lawful basis to collect or process;
- Attempt to access another customer's data, probe the Service for vulnerabilities, or interfere with its normal operation;
- Reverse-engineer, resell, or white-label the Service without our written agreement; or
- Use the Service in a way that infringes anyone's intellectual property or privacy rights, or that's otherwise unlawful.
We may suspend or terminate accounts that violate this section, with notice where practicable.
6. Your data
You own the data you put into CRM-007 — your contacts, companies, deals, and messages — and the data your tracking snippet collects about your own website's visitors. We process that data on your behalf, as described in our Privacy Policy. If you need a formal Data Processing Agreement for your own compliance purposes, contact us at privacy@crm007.com.
When your account is closed, we delete your tenant database and any associated files within a commercially reasonable time, except where we're required to retain records (for example, billing records) for longer under applicable law.
7. Service availability
We aim to keep the Service available and reliable, but we don't guarantee uninterrupted access. We may perform maintenance, and features may change as the product evolves. We'll try to give notice of any change that materially reduces functionality you're actively relying on.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement — including as to the accuracy of visitor identification, lead scoring, or AI-generated content, all of which are provided on a best-effort basis and should be reviewed before you rely on them.
To the maximum extent permitted by law, CRM-007 will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law or other applicable law.
9. Termination
You can stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, including non-payment, and we'll try to give you notice and a reasonable opportunity to fix the issue first, except where we reasonably believe immediate suspension is necessary to protect the Service or other customers.
10. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we'll notify you — by email or an in-app notice — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Queensland, Australia, without regard to its conflict-of-laws principles, and you submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms or the Service.
